Recently, Canada published 《 amendments to Certain (Surface Coating Materials) Regulations in the Canada Consumer Product Safety Act (CCPSA)(SOR/2022-122) to modify and harmonize the five regulatory requirements of CCPSA related to surface coating materials. All requirements will be effective December 19, 2022.
The five regulations are as follows:
■ Cribs, Cradles and Shakers Regulations (SOR/2016-152)
■ Infant Barriers Regulation (SOR/2016-179)
■ Infant Fence Regulations (SOR/2018-186)
■ Surface Coating Material Regulations (SOR/2016-193)
■ Toy Regulations (SOR/2011-17)
Revisions to surface coating materials include:
extend the definition of "surface coating material" to include surface coatings that do not dry out during application, such as electrostatically sprayed powder coatings, and decorative surface coatings such as stickers or films.
B. Extension of the total lead limit of 90 mg/kg to the surface coating of furniture.
c. Removal of heavy metal restrictions on the surface coating of non-contact parts of the product.
d. Outdated test methods removed.
The legislation is specifically updated as follows::
SOR/2016-193 Surface Coating Material Regulations
(1) The regulations define the terms "surface coating materials" and "accessible parts:
a. "Surface coating material" means a paint or other similar material, with or without pigment, that forms a solid film after application to a surface and can be removed.
B. "Contactable part" means any part of the product that may be touched, licked, orally or swallowed during reasonably foreseeable use of the product.
(2) The total lead limit of 90 mg/kg will apply to removable stickers, films or other similar materials, or surface coating materials on the following product-accessible parts:
a. Furniture (expanded from children's furniture to all furniture)
b. Children's Articles
c. Pencil
d. Artist brush
SOR/2011-17 Toys Regulations, SOR/2016-152 Cribs and Cradles Regulations, SOR/2016-179 Extended Doors and Guardrails Regulations, SOR/2018-186 Gaming Fence Regulations
(1) For products within the scope of the above regulations, removable stickers, films or other similar materials on accessible parts, or surface coating materials shall not exceed the following limits:
a. Total lead ≤ 90 mg/kg
b. Migration of antimony, arsenic, cadmium, selenium or barium compounds ≤ 1000 mg/kg
c. Total mercury ≤ 10 mg/kg
(2) The test method specified in the corresponding regulations (use 5% hydrochloric acid for 10 minutes at 20°C) will be deleted. Any test method can be used to verify compliance if it meets good laboratory practice.
